New Legislation Limits Pay Suspension of Police Officers

Governor Corzine signed legislation on March 5th that enables law enforcement officers (and firefighters) who have been suspended without pay to regain pay status when appeals of termination are not resolved within 180 days. The bill excludes individuals who are the subject of a criminal investigation or when the allegations constitute a violation of criminal law.
The measure includes provisions designed to expedite the hearing processes, so that a final determination can be made within the 180-day period.
Governor Corzine, in acknowledging that the fact-finding and deliberative process can take many months, said that it “...places a very heavy burden on people, who then must cope with extreme financial hardship caused by a protracted suspension of salary at a difficult and emotional time when their careers are, essentially, in limbo.”
The bill applies to all full-time officers employed by any state, county, municipal department or division. Starting on the 181st day following their suspension without pay, officers would begin to receive their base salary and continue to receive their salary until the matter is resolved.
