NJ State Police Seek Change in Mandatory Retirement Age

New Jersey State Police officers filed a lawsuit March 3, 2009 challenging the mandatory retirement age of 55. Contending the retirement policy is discriminatory and outdated, the troopers say retirement should be based on physical standards, not age.
According to the Philadelphia Inquirer, similar challenges have been mounted in New York, Massachusetts, Kentucky and Pennsylvania. In all but Pennsylvania, the troopers were victorious and received millions in back pay and health benefits. In Pennsylvania, the state Supreme Court upheld the mandatory retirement age of 60 which remains in effect today.
Two days after New Jersey State Police officers filed their suit, Sen. Paul Sarlo (D-Bergen) said he planned to introduce legislation next week that would increase the mandatory retirement age for State Police to 60, as long as they meet the annual physical requirements.
